Cert Alert! Esteras v. US

The Supreme Court has granted cert in Esteras v. United States, 23-7483. Section 3583(e) of Title 18 states what § 3553 factors the court can consider when revoking supervised release. The statute does not cite 3553(a)(2)(A). Mr. Esteras thus argues that a judge should not consider “the need to reflect the seriousness of the offense, promote respect for the law, and to provide just punishment for the offense” in determining what sentence to impose upon revocation. So, preserve those objections while we wait for the Supreme Court to resolve the issue. The argument date is TBD.
